Ninth Circuit judges Wednesday questioned attorneys for an Idaho LGBTQ+ student rights group about the actual harms its transgender members at Boise High School face, in light of a state law requiring students to use restrooms corresponding with their sex assigned at birth.
Judge Morgan Christen, of the US Court of Appeals for the Ninth Circuit, said the panel “can’t tell from this record” whether transgender members of the Sexuality and Gender Alliance are being “outed” or facing other alleged harms by being forced to only use the limited number of single-stall restrooms available on campus.
