Ninth Circuit Reverses PhRMA Win Against Oregon’s Drug Law (1)

The drug industry’s top lobbying group suffered a loss Tuesday after a federal appeals court reversed a decision that ruled an Oregon law compelled speech and took their property.

The US Court of Appeals for the Ninth Circuit reversed and remanded back to a lower court a decision in favor of the Pharmaceutical Research and Manufacturers of America’s claims against Oregon’s HB 4005, a law that requires prescription drug manufacturers to report information related to certain prescription drugs to the state’s Department of Consumer and Business Services.
