Nature’s Way Products LLC failed in its bid to revive a trademark infringement counterclaim, a federal appeals court said, because it didn’t show sufficient evidence of a likelihood of confusion in the US market.
A district court properly granted summary judgment to Doctor’s Best Inc. in the trademark dispute between the two competitors, Judge Richard A. Paez, of the US Court of Appeals for the Ninth Circuit, said.
