Federal appeals court judges at a Wednesday hearing appeared receptive to arguments that a group of doctors and a former NBA star challenging the Washington Medical Commission’s investigation into their alleged spreading of Covid-19 misinformation must stay in state court.
A federal trial court in Washington had dismissed the free speech challenge under a doctrine, known as Younger, barring federal courts from intervening in certain state court proceedings. The lawsuit was filed by Washington physicians who say they are being investigated by the commission for expressing skepticism of the Covid-19 vaccine.
