Ninth Cir. Rejects En Banc Review in Arizona Election Fraud Case

The full Ninth Circuit declined to review a sanctions order against attorneys who represented then-Arizona gubernatorial candidate Kari Lake (R) in a 2022 case challenging the state’s electronic voting systems.

Judge Lawrence VanDyke dissented, saying the case was worthy of en banc review by the US Court of Appeals for the Ninth Circuit because the district court “flatly misread” the complaint’s allegations, and “boldly proclaimed” that it imposed sanctions “with the hope that doing so would ‘send a message’ to deter future litigants with similar claims.”
