Nike Wins on Appeal in Case Over ‘Sustainable’ Clothing Label

Nike USA escaped claims that the retailer falsely marketed its “Sustainability” line of clothing as environmentally friendly after the Eighth Circuit declined to revive a proposed consumer class action Friday.

Lead plaintiff Maria Ellis failed to follow the lower court’s rules for preserving the opportunity to amend her complaint in the event that the court dismissed the case, the US Court of Appeals for the Eighth Circuit said.
