NIBCO Inc.'s $7.65 million settlement to resolve class claims over allegedly defective polyethylene tubing remains intact, after the Fifth Circuit rejected the sole objector’s challenges to the deal.

Objector Jose Garcia argued that the settlement fund was inadequate, but the US Court of Appeals for the Fifth Circuit said in an unpublished Wednesday decision that there was no basis for upending its approval by the district court.
