NHL Likely to Defeat Video-Privacy Suit Over Use of Meta Pixel

A video-privacy lawsuit against the National Hockey League over its use of tracking technology from Meta Platforms Inc. on NHL-related websites should be dismissed, a federal magistrate judge recommended.

The plaintiffs in the proposed class action didn’t show that the NHL allowed Meta to collect personally identifiable information as defined in the Video Privacy Protection Act, or that the league’s conduct triggered liability under the federal Electronic Communications Privacy Act despite being a party to the communications, Magistrate Judge Barbara Moses of the US District Court for the Southern District of New York said Aug. 29.
