NFL Urges Supreme Court to Review Video-Privacy Suit Against NBA

The National Football League called on the US Supreme Court to take up a case accusing the National Basketball Association of violating federal privacy law in order to resolve a circuit split.

The Video Privacy Protection Act bars businesses from disclosing information about what videos consumers watch without their consent. The Second Circuit ruled below that “consumers” under that law means people who pay for any service from a video provider. The Sixth Circuit has since ruled that the term is limited to those who pay for video-related services.
