New York’s Prevailing Wage Expansion Challenged by Contractors

New York’s prevailing wage law expansion to include workers at off-site fabrication facilities drew a legal challenge Thursday from a group of construction contractors and trade organizations, which alleged the law could destroy the state’s public construction industry.

The amended law, set to take effect June 18, isn’t meant to “advance any legitimate worker protection interest,” the lawsuit said, but instead is intended to boost business for companies that fabricate their products in New York.

“In addition to unconstitutionally targeting out-of-state fabricators, the Amendment is unfeasible and will devastate New York’s public construction industry,” the complaint said, which was filed ...
