New York Votes to Enshrine Abortion Rights in State Constitution

New Yorkers overwhelmingly approved a constitutional amendment protecting abortion and prohibiting discrimination on the basis of pregnancy outcomes and other factors, the Associated Press said Tuesday.

The measure (Proposition 1), also known as the Equal Rights Amendment, protects “against unequal treatment” based on gender identity, sexual orientation, pregnancy, and reproductive health care and autonomy. New York already allows abortion until fetal viability, or roughly 24 weeks of pregnancy, and has a shield law protecting abortion providers from investigations initiated by other states.
