A lawyer in New York doesn’t have to face a malpractice lawsuit stemming from a foreclosure action after a federal judge in that state held that the suit was filed too late.
Denise and John A. Meskunas, a previously married couple and co-members of Important Properties LLC, sued Lee David Auerbach PC for legal malpractice after Auerbach allegedly didn’t inform Denise of the risks she faced by not making payments for Important’s mortgage. Important leased property to a Harley Davidson motorcycle dealership.
