New Orleans Residents Fail to Revive Landfill Cleanup Lawsuit

New Orleans can avoid a lawsuit by residents of a primarily Black neighborhood built on top of a former landfill, the Fifth Circuit affirmed Tuesday, ruling the residents failed to show the city isn’t minimizing contamination as part of an agreement with the EPA.

A citizens group called the Residents of Gordon Plaza argued the site is still contaminated with hazardous chemicals, and they wanted the court to force the city to conduct environmental testing and clean up the site. However, the lawsuit failed to mention a 2008 consent decree between the city and the Environmental Protection Act.
