A federal appeals court on Friday upheld a New Jersey law banning out-of-state retailers from selling wine online and shipping it directly to in-state customers.
The regulations do “impose a heightened financial burden” on out-of-state sellers, but New Jersey has a legitimate public-health interest in ensuring that all alcohol sold to in-state consumers passes through its state regulatory system, according to an opinion from the US Court of Appeals for the Third Circuit.
The opinion, written by Judge L. Felipe Restrepo, also noted that states have significant freedom to impose their own alcohol-related public safety measures.
