New Jersey Hazardous Waste Company Can’t Escape Cleanup Suit

The US can proceed with its environmental cleanup lawsuit against two New Jersey hazardous waste companies after a district court determined the government sufficiently alleged successor liability.

The US District Court for the District of New Jersey on Tuesday denied the motion to dismiss the government’s lawsuit that had been filed by one of the two defendant companies, according to Judge Julien Xavier Neals’ opinion. Neals ruled that the government made both sufficient and plausible claims against the companies under the Comprehensive Environmental Response, Compensation, and Liability Act.
