New Jersey Fair Housing Law Survives Equal Protection Challenge

Nearly two dozen New Jersey municipalities failed to properly plead that the state’s Fair Housing Act violates the 14th Amendment’s equal protection clause.

The municipalities lack standing to sue the state, and their elected officials failed to present a redressable injury, the US District Court for the District of New Jersey said in a Tuesday opinion dismissing the claims without prejudice or further leave to amend.
