New Hampshire Hospital Is Stuck With Suit on Google Info Sharing

Southern New Hampshire Medical Center must face a proposed class action alleging it shared the sensitive information of patients with Google LLC without their consent in violation of state privacy laws.

Lead plaintiff Daniel Cancelmo adequately pleaded the elements of a claim of violations of the state’s Wiretap Act, Judge Samantha D. Elliott of the US District Court for the District of New Hampshire said.

Elliott dismissed the plaintiff’s claim of violations of the New Hampshire statute regulating the disclosure and use of protected health information for marketing purposes, but gave him leave to file an amended complaint.
