The granting of a new trial in a fraudulent transfer dispute involving tens of millions of dollars in assets was improper despite unprofessional conduct by defense attorneys that included personal attacks on witnesses, a state appeals court ruled.
The original trial concerned an alleged fraudulent transfer of assets after a judgment of nearly $50 million in a real estate investment dispute. Although two Texas lawyers made numerous inappropriate comments during the trial, their conduct never reached the point that it likely impacted a jury verdict, the appeals court ruled in calling off a second trial.
