Nevada employers can be sued by workers for failing to accommodate their state-sanctioned use of medical marijuana outside of the workplace, the state’s top court ruled.
The unanimous decision Thursday rejected Freeman Expositions LLC’s contention that journeyman James Roushkolb lacks a private cause of action against it under Nevada Revised Statutes chapter 678C. The law, which permits the use of cannabis to treat certain medical conditions by qualifying patients, doesn’t expressly authorize workers to sue employers, but it implies such a right, the state justices said.
