An $8 million class settlement with Neuriva manufacturer Reckitt Benckiser LLC was vacated by the Eleventh Circuit Wednesday after the court ruled plaintiffs lacked standing to ask a judge to issue an injunction over the company’s allegedly false brain supplement advertising.
Sidestepping a fairness claim on which a class member originally brought his appeal, the US Court of Appeals for the Eleventh Circuit found a lower court wrongfully barred Reckitt Benckiser and RB Health (US) LLC from using certain terms in its marketing.
