Nestlé Will Face Class Action Over ‘Sustainable Sourced’ Labels

A consumer who is alleging Nestlé USA Inc. used deceptive packaging, which touted its chocolate products as “sustainably sourced,” was granted class certification by a federal court.

Marie Falcone said she bought Nestlé products because of the statements on the labels, but the cocoa was harvested on West African plantations that use child slave labor. Falcone sued the company under the California Consumer Legal Remedies Act and Unfair Competition Law.

Nestle previously fought off a couple of other class actions in brought in Massachusetts and California, aimed at its packaging and alleged failure to disclose ties between cocoa production ...
