Nestle Takes Worker’s Genetic Data Privacy Suit to Federal Court

Nestle USA Inc. removed a state lawsuit alleging it collected the family medical information of employees in violation of the Illinois genetic-privacy law to federal court.

Removal of the proposed class action was proper under the Class Action Fairness Act because the putative class includes more than 100 people, there exists a diversity of citizenship between Nestle and lead plaintiff Derrence Winfield, and the amount in controversy plausibly exceeds $5 million, Nestle said in a notice of removal filed Wednesday in the US District Court for the Northern District of Illinois.
