Nestlé USA Inc. was hit with a proposed false advertising class action alleging the company misbranded Perrier products as “natural mineral water” from a specific spring in France when the company began blending water from various sources.
The Food and Drug Administration says “significant alterations to the source water for mineral water are material facts which must be disclosed on the label, because it is no longer unmodified ground water and differs significantly from the water that was harvested,” the complaint filed by Kevin O’Rourke in the US District Court for the Eastern District of New York on Monday says. ...
