Nestlé Healthcare Nutrition Inc. convinced a federal judge to grant summary judgment on a handful of claims in a proposed class action alleging it deceptively marketed its Boost Glucose Control drinks, but will have to face claims that the name of the product is misleading.
The US District Court for the Northern District on April 18 granted judgment to the company on claims from a plaintiff who continued buying the product after filing her lawsuit. The court also limited the other plaintiffs’ claims.
