North Carolina State won dismissal of claims by three former student athletes who allege they were sexually abused by the university’s director of sports medicine.
The plaintiffs’ Title IX claims against N.C. State fail because they didn’t show that the school had actual notice of the alleged abuse by Robert M. Murphy Jr.
Allegations sufficient to constitute notice must describe “a specific incident” of sexual harassment, Judge Louise W. Flanagan of the US District Court for the Eastern District of North Carolina said.
