The Biden administration’s defeat of a civilian Navy employee’s court challenge to the government’s Covid-19 vaccine mandate has been upheld on appeal.
The ruling Tuesday makes the US Court of Appeals for the District of Columbia Circuit the latest circuit to find a court challenge to the September 2021 mandate by President Joe Biden (D) is barred by the Civil Service Reform Act.
The CRSA established an exclusive statutory scheme for federal workers to challenge adverse job actions, removing the jurisdiction of federal district courts to hear such claims, the D.C. Circuit said.
