N.Y. State Special Counsel Gets Reprisal Trial Against Ex-Boss

A former executive deputy commissioner for the New York State Division of Criminal Justice Services must face trial on an attorney’s claims that she was demoted for speaking out against misconduct, including offensive statements by a former subordinate.

A jury could find Michael C. Green violated Gina Bianchi’s rights under the First Amendment, the Equal Protection Clause, and state workplace bias law, the US District Court for the Northern District of New York said.
