MyEyeDr. Stuck With Google Analytics Online Privacy Class Suit

MyEyeDr.—or Capital Vision Services LLC—couldn’t convince a federal court to dismiss the entirety of a proposed Google Analytics online tracker class suit.

The eye health services provider will continue to face negligence, unjust enrichment, and Electronic Communications Privacy Act claims. The US District Court for the Northern District of Illinois rejected MyEyeDr.'s arguments that the federal Wiretap Act’s crime-tort exception shouldn’t apply to the ECPA cause of action, and the state recognizes a common law duty to protect personal information.
