MyEyeDr Gets Mixed Ruling in Ex-Manager’s Bias, Retaliation Suit

Capital Vision Services LLC scored an early win on some claims in a former manager’s suit alleging several forms of discrimination and retaliation, but material fact issues mean others will go forward, a federal judge said.

The optometry chain, which does business as MyEyeDr at more than 800 practices, won’t have to face the ex-employee’s sexual orientation, race and national origin, and age discrimination claims, his allegations of Family and Medical Leave Act retaliation, or his Americans with Disabilities Act disparate treatment claim, the US District Court for the District of Delaware said.
