MV Transportation Can Arbitrate Driver’s Genetic Privacy Suit

MV Transportation Inc. can arbitrate the individual claims of a job applicant who was leading a class action over the paratransit service company’s alleged violations of Illinois’ Genetic Information Privacy Act.

Kevin Short wasn’t the original lead plaintiff in the case filed in the US District Court for the Northern District of Illinois. The court had already denied MV Transportation’s motion to dismiss with him as the lead representative when it discovered that Short, unlike the original plaintiff, had signed an arbitration agreement.
