Musk, X Corp. Can’t Make Ex-Twitter Officer Arbitrate Claims (1)

Elon Musk and X Corp. must defend in federal court breach of contract claims by Twitter Inc.‘s former chief marketing officer, after a federal judge denied their bid to compel arbitration.

Multiple agreements—a dispute resolution agreement with an arbitration clause and award agreements that stipulated venue—applied to Leslie Berland’s claims against Musk and X, Judge Jacqueline Scott Corley said July 25 for the US District Court for the Northern District of California.

Under California law, the award agreements, which were signed after the dispute resolution one, control, Corley said.
