A federal court rejected Elon Musk’s argument that tweets he made about fake Twitter accounts after he agreed to purchase the company weren’t materially misleading.
Musk made the same argument when he filed his motion to dismiss in 2023, Judge Charles R. Breyer said Monday for the US District Court for the Northern District of California. The law of the case doctrine therefore bars him from making the same argument now, Breyer said.
