Music-Festival Promoter Insomniac Must Face Video-Privacy Suit

Music-festival promoter Insomniac Holdings LLC must face a proposed class action alleging it disclosed consumers’ video-viewing histories to Meta Platforms Inc. and TikTok Inc. without consent in violation of the Video Privacy Protection Act.

Lead plaintiff Austin Ballard sufficiently alleged that Insomniac was a “video tape service provider” as defined under the VPPA and that he was a “consumer” under the act, Judge Susan Illston of the US District Court for the Northern District of California said Tuesday.

Illston denied the company’s motion to dismiss.
