The host of the “Mueller, She Wrote” podcast sued the Justice Department Thursday over its creation of the $1.776 billion “Anti-Weaponization Fund,” saying the federal government failed to follow required public comment procedures.
Allison Gill, who worked as a health specialist at the US Department of Veterans Affairs from 2009 to 2020, alleges the US Department of Justice violated the Administrative Procedure Act by creating the fund without publishing proposed rules in the Federal Register or allowing public comment, according to her complaint filed in the US District Court for the Southern District of California.

“By failing to engage in the notice-and-comment rulemaking process, defendants have deprived plaintiff of her ability to protect her financial and due process interests through the submission of comments on a proposed rule,” Gill said.
The DOJ didn’t immediately respond to a request for comment.
Gill believes she was targeted by the government in 2019 when the VA investigated her and her podcast due to her criticism of Trump. She claims eligibility for compensation from the fund but wants to ensure it operates legally and fairly, the complaint says. Her podcast was started to follow the special counsel inquiry into Trump’s Russia relations during his first term.
Gill also raised concerns about potential payments to people accused of attacking the Capitol on Jan. 6, 2021, and questions whether fund commissioners require Senate confirmation under the Constitution.
“The Trump administration’s attempted theft of $1.8B in taxpayer money to reward his criminal co-conspirators is an insult to those of us who faced actual weaponization at the hands of the president and his allies,” Gill said in a press release.
