MTA Fends Off Workers’ Pay Frequency, but Not Overtime Claims

The Metropolitan Transportation Authority is a governmental agency exempt from the frequency of pay requirements of New York labor law, a federal court said.

But the operator of the New York City subway must still face it workers’ claims that they’re entitled to overtime under the Fair Labor Standards Act, Judge Joan M. Azrack said Thursday for the US District Court for the Eastern District of New York.

Under the NYLL, the term “employer” doesn’t “include a governmental agency.” But the workers pointed out that another provision of the statute requires “every railroad corporation” to mail employees their checks weekly. ...
