Mother Suing For Coverage From Bus Crash Gets Second Chance

A mother and daughter who were in a school bus crash will have another opportunity to challenge a rejected insurance claim after a federal appeals panel deemed a lower court improperly sided with the insurer.

The district court erred when it granted National Union Fire Insurance Co. of Pittsburgh summary judgment since the court’s reasoning relied on an argument the insurer never raised in its claim denial, the US Court of Appeals for the First Circuit ruled Thursday in an opinion.
