Philadelphia must face a privacy lawsuit, filed by the mother of a man who died by suicide, over a photograph of his body that was taken by a city police officer and posted on social media.
Plaintiff Karen Brookins adequately stated a privacy claim under the Fourteenth Amendment against the officers at the scene in their individual capacities for taking and circulating the photograph of her son, Judge Mark A. Kearney of the US District Court for the Eastern District of Pennsylvania said April 30.
