Most Greenwashing Claims Against Evian Parent Can Go Forward

Consumers who say a “carbon neutral” label on Evian bottled water was greenwashing can proceed with claims that the label is deceptive and fraudulent, in a suit against parent company Danone Waters of America Inc., a federal judge said.

The US District Court for the Southern District of New York said it couldn’t, as a matter of law, determine whether representations that the product was carbon neutral has the capacity to be misleading.
