Most Claims Over Subaru Starlink Infotainment System Can Proceed

Subaru of America Inc. failed to convince a federal judge to dismiss fraud, warranty, and most state consumer protection claims in a proposed class action alleging 2019-2023 models had defective Starlink in-vehicle infotainment systems.

The US District Court for the District of New Jersey on Tuesday declined to dismiss common-law fraud, warranty, and unjust enrichment claims because it’s too early to conduct a choice-of-law analysis to determine which law among the six states the plaintiffs come from controls.
