Most ByteDance Sales Reps Must Arbitrate Overtime Wage Claims

A group of current and former ByteDance Inc. employees must arbitrate their claims that the company failed to pay them overtime in violation of the Fair Labor Standards Act, except for one.

The company failed to show that one of the plaintiffs entered into an arbitration agreement, since the clause doesn’t incorporate the contract that outlines the terms of arbitration, Judge Nathanael M. Cousins of the US District Court for the Northern District of California said in a Tuesday order partially denying ByteDance’s motion to compel arbitration.
