Software firm Mosaic Learning Inc. escaped an infringement lawsuit over its “mosaic learning” trademark, which RLP Ventures LLC asserted infringed upon its “MOSAEC” mark.
“While it is true that both parties’ marks use the word ‘mosaic,’ or a misspelling thereof, that is where the similarities end,” Judge Naomi Reice Buchwald of the US District Court for the Southern District of New York said in a Tuesday order dismissing the case with prejudice.
