Morgan & Morgan Keeps Suit in Federal Court, Can Arbitrate

Morgan & Morgan, Jacksonville PLLC succeeded both in enforcing an arbitration clause in its contract with a former client who accused the personal injury law firm of malpractice and in keeping the case in federal court.

The agreement’s arbitration provision is enforceable under the Federal Arbitration Act, said Judge Lisa Godbey Wood in an opinion Monday for the US District Court for the Southern District of Georgia. Plaintiff Mark Gugliuzza didn’t meet the burden of showing that the arbitration provision shouldn’t be enforced, Wood said, granting Morgan & Morgan’s motion to compel arbitration.
