Monsanto’s Suit Against PCB Buyers Remains in Federal Court

General Electric Co. and other buyers of PCBs from Monsanto Co. will be able to keep the agrochemical company’s liability lawsuit in district court, a split federal appeals court ruled Wednesday.

GE’s motion to remove Monsanto’s suit from Missouri state court on Feb. 20, 2024 was within the 30-day window after its Jan. 31, 2024 waiver of service of process, the majority said in an opinion. The majority for the US Court of Appeals for the Eighth Circuit vacated a district court’s order to remand the lawsuit.

Judges Ralph R. Erickson and David R. Stras joined the majority.
