Monsanto Gets NJ PCB Contamination Dispute Sent to Missouri (1)

Monsanto convinced a New Jersey appeals court Tuesday that Missouri is the right place to decide whether Garden State companies can escape liability for chemicals purchased from the agrochemical giant.

Magnetek, Inc.'s challenge to “special undertaking agreements” its predecessor company struck with Monsanto should be decided in Missouri, the New Jersey Superior Court Appellate Division ruled. Missouri state courts are hearing more than 100 similar lawsuits sorting out responsibility for more than a billion dollars in polychlorinated biphenyls (PCB) contamination and personal injury claims.
