A proposed class action alleging Saraya USA Inc. tricked consumers into buying its alternative sweetener made with monkfruit extract should be dismissed because the plaintiff didn’t sufficiently allege label statements were false, a magistrate judge recommended.
“The crux of Plaintiff’s claim is that the Products are falsely advertised” as zero calorie and zero net carbohydrate, but the consumer didn’t provide supporting allegations to show that the products aren’t actually zero calorie or carb free, Judge James M. Wicks said in his report to the US District Court for the Eastern District of New York. The report was entered Tuesday.
