Mold Suit Against Military Housing Owner Belongs in State Court

The owner and manager of military housing in San Diego failed to convince the Ninth Circuit to keep a resident’s lawsuit over its handling of mold in federal court.

San Diego Family Housing LLC didn’t show that the US government has exclusive jurisdiction over the property or that the property owner’s challenged actions occurred because the government asked it to do something , Judge Gabriel P. Sanchez wrote for the US Court of Appeals for the Ninth Circuit Thursday.
