Minnesota’s requirement that social media companies provide users a conspicuous mental health warning label on their websites is unconstitutional, NetChoice said in a federal lawsuit Wednesday.
The state has many ways to warn its residents about the potential harms of social media. But NetChoice told the US District Court for the District of Minnesota that the state can’t compel social media platforms to deliver that message in a prescribed format.
Minnesota didn’t immediately respond to a request for comment.
