Minnesota Political Deepfake Ban to Stay in Place During Lawsuit

Minnesota can continue enforcing a 2023 law banning the dissemination of AI-generated deepfake videos meant to influence elections while litigation challenging the measure proceeds, a federal appeals court ruled Monday.

A lower court properly denied state Rep. Mary Franson (R)'s motion for a preliminary injunction because she waited 16 months after the law was passed to request it, the US Court of Appeals for the Eighth Circuit said.

Her failure to act sooner undercuts the “sense of urgency that ordinarily accompanies a motion for preliminary relief,” Chief Judge Steven M. Colloton said for the court.
