A certified nursing assistant won conditional collective certification for a suit accusing her employer of automatically deducting pay for scheduled meal breaks she was unable to actually take.
The Monarch Healthcare Management LLC worker met her burden of showing she’s sufficiently similarly situated to other employees in the proposed Fair Labor Standards Act collective, making tentative group status appropriate, the US District Court for the District of Minnesota said Thursday.
