Millionaire Dating Site Denied Arbitration in Data Privacy Suit

A dating site for millionaires can’t compel arbitration over a user’s proposed class action because it didn’t clearly give him notice required by California law, a federal court said.

Judge P. Casey Pitts, of the US District Court for the Northern District of California, said Michael Massel never consented to Millionaire Match’s service agreement that included an arbitration provision when he created his account on the website. The “Service Agreement and Privacy Policy” hyperlinks weren’t “reasonably conspicuous enough” to put Massel on notice of the terms.
